When can you exceed the speed limit without getting a fine?

Currently, all roads in our country have regulations on maximum speed limits, and drivers who exceed the speed limit will be fined, but there are some cases where no penalty is imposed.

Driving a car or motorcycle at speeds exceeding the legal limit is strictly prohibited under the 2008 Road Traffic Law. Violators of this speeding rule may be subject to penalties as stipulated in Decree 100/2019/ND-CP.

When is speeding not punishable?

However, there are still cases where drivers of cars and motorcycles exceed the speed limit but are not fined by traffic police.

Specifically, according to point a, clause 3, Article 5 and point c, clause 2, Article 6 of Decree 100/2019/ND-CP, only drivers of cars and motorcycles exceeding the speed limit by 05 km/h or more will be penalized.

3. A fine of between VND 800.000 and VND 1.000.000 shall be imposed on drivers who commit any of the following violations:

a) Driving a vehicle exceeding the speed limit by 05 km/h to less than 10 km/h.

c) Driving at a speed exceeding the prescribed limit by 05 km/h to less than 10 km/h".

Therefore, if a driver of a car, motorbike, etc., exceeds the speed limit by less than 5km/h, they will not be fined but will instead receive a warning from the traffic police.

For example, on a road where the maximum speed limit is 40 km/h, driving at 44 km/h will not result in a fine.

However, to ensure the safety and health of themselves and others, everyone should strictly adhere to speed regulations when participating in traffic.
